Welcome to Dark Horse Watches LLC. These Terms of Service ("Terms") govern your use of our website www.darkhorsewatches.com ("Site") and your purchase of products and services from Dark Horse Watches LLC ("we," "us," or "our").
By accessing our Site or making a purchase, you agree to these Terms. Please read them carefully before proceeding.
1. DEFINITIONS
For purposes of these Terms:
"Watch" or "Timepiece" refers to any luxury watch offered for sale through our Site or services.
"Full Set" means a watch accompanied by its original box, warranty card or papers, and any accessories originally included by the manufacturer.
"Watch Only" means a watch without original box, papers, or accessories.
"Condition Grade" refers to our assessment of a watch's physical condition, as described in the product listing.
"Authentication" refers to the process of verifying a watch's genuineness, components, and condition.
"Consignment" refers to watches owned by third parties that we offer for sale on their behalf.
"Sourcing" or "Procurement" refers to our service of locating specific watches on behalf of customers.
"Trade-In" refers to the exchange of a customer's existing watch as partial payment toward a purchase.
2. INDEPENDENT DEALER STATUS
Dark Horse Watches LLC is an independent dealer of pre-owned and vintage luxury watches. We are NOT an authorized retailer, representative, or affiliate of any watch manufacturer, including but not limited to Rolex, Patek Philippe, Audemars Piguet, Omega, Cartier, Tudor, or any other brand we may offer.
All manufacturer names, logos, and trademarks appearing on our Site or products belong to their respective owners and are used solely for identification purposes.
Manufacturer warranties may not apply to watches purchased from us. Any guarantee provided is offered directly by Dark Horse Watches LLC as described in Section 8 of these Terms.
3. PRODUCTS AND DESCRIPTIONS
3.1 Accuracy of Listings
We make every effort to accurately describe and photograph each watch. All photographs on our Site are of the actual watch being offered unless otherwise noted. We do not use stock photos.
However, slight variations in color, texture, or appearance may occur due to differences in monitors, lighting conditions, or photographic limitations. These minor variations do not constitute misrepresentation.
3.2 Condition Descriptions
Each watch is assigned a condition grade based on our inspection. These grades are subjective assessments based on our professional judgment. Common condition grades include:
Unworn/New: Never worn, with all factory protections intact
Mint/Excellent: Minimal to no signs of wear
Very Good: Light wear consistent with occasional use
Good: Moderate wear consistent with regular use
Fair: Visible wear, scratches, or signs of aging
Detailed condition notes are provided in each listing. We encourage you to review all photographs and descriptions carefully and contact us with any questions before purchasing.
3.3 Service History
When available, we provide information about a watch's service history. However, complete service records are not always available, particularly for vintage pieces. The absence of service documentation does not indicate that a watch has not been properly maintained.
3.4 Availability
All watches are subject to prior sale. We reserve the right to remove listings or decline orders at any time, including after an order has been placed. In such cases, any payment received will be refunded in full.
4. PRICING AND PAYMENT
4.1 Pricing
All prices are listed in United States Dollars (USD). Prices do not include applicable taxes, duties, or shipping costs, which will be calculated at checkout or communicated before payment.
We reserve the right to change prices at any time without notice. However, once an order is confirmed and payment is received, the price is locked.
4.2 Accepted Payment Methods
We accept the following payment methods:

Zelle
We do not accept credit card payments. This policy protects both parties from fraud and allows us to offer more competitive pricing by avoiding merchant processing fees.
4.3 Payment Terms
Full payment is required before shipment. Orders are not considered confirmed until payment is received and cleared.
Wire Transfers: Funds must be received and verified before shipment. International wire transfers may take 3-5 business days to clear.
Zelle: Payment must be confirmed before shipment.
4.4 Deposits
For certain items, special orders, or holds/reservations, we may require a deposit. All deposits are non-refundable. Deposit terms will be clearly communicated before any payment is made.
4.5 Taxes
Buyers are responsible for all applicable sales tax imposed by their jurisdiction. Dark Horse Watches LLC will collect sales tax where required by law.
5. SHIPPING AND DELIVERY
5.1 Shipping Methods
All watches are shipped via FedEx with full insurance coverage and signature required upon delivery.
5.2 Shipping Timeline
Orders typically ship within 3 business days of payment confirmation. You will receive tracking information once your order ships.
We are not responsible for shipping delays caused by carriers, weather, or other circumstances beyond our control.
5.3 Insurance and Risk of Loss
All shipments are fully insured for the purchase price. Risk of loss transfers to the buyer upon delivery to the shipping carrier.
If a package is lost or damaged in transit, Dark Horse Watches LLC will work with the carrier to file an insurance claim. Resolution will be provided only after the claim is processed.
5.4 Delivery Requirements
An adult signature is required for all deliveries. If you are unavailable to sign, the carrier will attempt redelivery or hold the package at a secure location.
Buyers are responsible for providing accurate shipping information. We are not responsible for delays or losses resulting from incorrect addresses.
5.5 Shipping Territory
We ship to addresses within the United States only. We do not offer international shipping at this time.
6. ALL SALES ARE FINAL
ALL SALES ARE FINAL. We do not accept returns, refunds, or exchanges on any purchase.
We encourage all buyers to carefully review all photographs, descriptions, and condition notes before purchasing. Please contact us with any questions prior to completing your purchase.
By completing a purchase, you acknowledge and agree that:
You have reviewed all available information about the watch
You have had the opportunity to ask questions
You understand the sale is final and non-refundable
You accept the watch in its described condition
The only exception to this policy is our Lifetime Authenticity Guarantee as described in Section 8.
7. AUTHENTICATION
7.1 Our Authentication Process
Every watch we sell is authenticated through our third-party authentication partner. This process includes verification of:
Case serial and reference numbers
Movement caliber and serial numbers
Dial, hands, and markers authenticity
Case, bezel, and bracelet components
Crown, crystal, and caseback
8. LIFETIME AUTHENTICITY GUARANTEE
We guarantee that every watch sold by Dark Horse Watches LLC is 100% authentic.
This is a LIFETIME GUARANTEE. If any watch we sell is proven to be counterfeit or fraudulent, we will provide a full refund of the purchase price.
To make a claim under this guarantee, you must:
Contact us with your concerns
Provide documentation supporting the claim (e.g., assessment from a qualified watchmaker or manufacturer service center)
Return the watch for our inspection
This guarantee covers authenticity only. It does not cover subjective opinions about condition, value, desirability, mechanical function, timekeeping accuracy, or any other aspect of the watch. This guarantee does not cover normal wear, damage, or modifications made after purchase.
9. NO WARRANTY
Dark Horse Watches LLC does not provide a warranty on watches sold. All watches are sold "AS IS" in their described condition.
We do not warrant or guarantee:
Mechanical movement performance or accuracy
Timekeeping precision
Water resistance
Future mechanical reliability
Manufacturer warranty transferability
We recommend having any pre-owned watch serviced by a qualified watchmaker after purchase to ensure optimal performance.
10. CONSIGNMENT SALES
Some watches on our Site may be offered on consignment from third-party owners. Consignment items are subject to the same authentication standards and final sale policy as our owned inventory.
All sales of consignment items are final, with no returns or exchanges.
11. TRADE-IN PROGRAM
11.1 Trade-In Process
We accept trade-ins toward purchases from our inventory. Trade-in values are determined based on current market conditions, brand, model, reference, condition, and completeness (box, papers, accessories).
11.2 Trade-In Terms
Trade-in offers are valid for 1 day from the date provided. Offers are contingent upon our physical inspection of the watch. If the watch's condition differs materially from its description, we reserve the right to adjust or withdraw the offer.
Trade-in watches become the property of Dark Horse Watches LLC upon completion of the transaction.
12. SOURCING AND PROCUREMENT SERVICES
12.1 Service Description
We offer sourcing services to locate specific watches on behalf of customers. This service utilizes our network of dealers, collectors, and wholesale sources.
12.2 Sourcing Terms
Sourcing services require full payment via wire transfer when a watch is located and presented to you. Pricing is determined when a watch is located.
ALL SOURCED WATCHES ARE FINAL SALE. No returns or exchanges are available on watches procured through our sourcing services.
Sourced watches are subject to our authentication process and Lifetime Authenticity Guarantee.
13. SELLING YOUR WATCH TO US
13.1 Purchase Process
We purchase watches directly from individuals. To sell us your watch:
1. Submit your watch details through our website or contact us directly
2. Receive our offer within 24 hours based on provided information and photos
3. If accepted, ship the watch to us using our prepaid insured label
4. We inspect and verify the watch upon receipt
5. Payment is issued within 24 hours of verification via bank wire transfer
13.2 Offer Terms
Offers are estimates based on the information you provide. Final purchase price is contingent upon our physical inspection. If the watch differs materially from its description, we reserve the right to adjust or withdraw our offer.
If you decline our final offer, we will return your watch at no cost.
13.3 Representations
By selling us a watch, you represent and warrant that:
You are the legal owner of the watch or authorized to sell it
The watch is not stolen, counterfeit, or subject to any liens or claims
All information provided about the watch is accurate to the best of your knowledge
14. LIMITATION OF LIABILITY
14.1 Disclaimer of Warranties
EXCEPT AS EXPRESSLY STATED IN THESE TERMS, ALL PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
14.2 Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DARK HORSE WATCHES LLC, ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE OUR SITE OR SERVICES, ANY TRANSACTION CONDUCTED THROUGH OUR SITE, UNAUTHORIZED ACCESS TO YOUR INFORMATION, OR ANY THIRD-PARTY CONTENT OR CONDUCT.
14.3 Maximum Liability
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR PURCHASE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.
15. INTELLECTUAL PROPERTY
All content on our Site, including text, photographs, graphics, logos, and design elements, is owned by Dark Horse Watches LLC or used with permission. This content is protected by copyright and other intellectual property laws.
You may view and download content for personal, non-commercial use only. You may not reproduce, distribute, modify, or publicly display our content without written permission.
16. DISPUTE RESOLUTION
16.1 Informal Resolution

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict of law principles.

Any dispute arising from these Terms or your purchase shall be resolved exclusively in the state or federal courts located in Dauphin County, Pennsylvania. You consent to the personal jurisdiction of these courts.
17. MODIFICATIONS
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our Site with an updated "Last Updated" date.
Your continued use of our Site after changes are posted constitutes acceptance of the modified Terms. Material changes affecting pending orders will not apply retroactively to orders placed before the change.
18. SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
19. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Dark Horse Watches LLC regarding your use of our Site and purchase of products or services.
